ANNUAL NOTIFICATION OF OPERATING A BUSINESS IN TERMS OF THE BUSINESS ACT, ACT NO 71 OF 1991 (REGULATION 15(2))

In respect of the above, notice is hereby given that every license holder must lodge a renewal application with the relevant licensing authority (Newcastle Municipality) by no later than 15:00 on the last working day of January of each year. As a result of the above, the license holder is required to provide the following information:-

1) Confirmation that the business for which the license was issued, is continuing to be conducted from the premises specified in the license and that no other business for which a license is required in terms of the Act is being conducted for the same licensed premises.

 2) The following items, in terms of Schedule 1 of the Business Act, requires that businesses must have a business license for:

(a) Item 1: Sale or supply meals or perishable foodstuffs.

(b) Item 2: Provision of certain types of health facilities or entertainment.

INTENTION TO LEASE A PORTION OF ERF R/1 THE MUNICIPAL LANDFILL SITE TO ENCOGENIX (PTY) LTD AND INALA ENERGY FOR A WASTE TYRE RECYCLING FACILITY

Notice is hereby given in accordance with Section 21 (1) (a) of the Municipal Systems Act No. 32 of 2000 and, also in terms of Section 6(b) of the Municipal Asset Transfer Regulations as promulgated in the Statutory Notice No. 878 dated 22 August 2008, read together with the provisions of Section 14 (2) (a) and (b) of the Municipal Finance Management Act No. 56 of 2003 and Section 49 (2) (d) of the Newcastle Supply Chain Management Policy. The intention and the reasons to lease a Portion of Erf R/1 within the Municipal Landfill site to Encogenix (Pty) Ltd and Inala Energy for a waste tyre recycling facility on a long term basis as approved by Council at the meeting held on the 26th September 2019.

PROPERTY DESCRIPTION

A portion of Erf R/1, measuring 2ha in extent to be leased to Encogenix (Pty) Ltd and Inala Energy on a long term lease of nine years (9) and eleven (11) months.

REASONS:

1 .The leased portion is situated on an unused section of the Landfill site and will not hamper operations of the landfill activities.

  1. That in terms of the waste hierachy recycling is the preferred option over disposal.
  2. The current Municipal Landfill site is nearing its full capacity and to divert some of the waste away from the

    landfill site will prolong the lifespan of the existing landfill which also reduces greenhouse gas emissions.

  3. The pyrolysis plant also has the capability of processing various grades of plastic which can be sourced from

    the landfill site by the informal recyclers, thus extending the life span of the site.

  4. It should be noted that the landfill site is fast reaching the end of its design life and it is critical that any efforts

    to divert waste for the landfill to be supported.

  5. It will generate much needed local employment as well as an income for the Municipality.
  6. Waste reductions forms part of the National Waste Management Strategy.

The public is hereby invited to comment to the Acting Municipal Manager on the said proposal and a copy of the Lease Agreement will be available for inspection in the office of the Strategic Executive Director: Development Planning and Human Settlements (Municipal Tower Block, 4th Floor), for a period of fourteen days during office hours, Monday to Friday from 07h30 to 16h00 until ……

Public Participation Unit

The Public Participation Unit under The Newcastle Municipality have, in line with the Ward Committee Operation plan coordinated and facilitated the Ward Committee Portfolio meetings commencing today the 4th of November to the 13thof November at the Council Chambers .

The purpose of these meetings is to create a direct communication between the council portfolio committees and the ward committee operations portfolios.  This will assist in ensuring that ward committee views, aspirations and inputs are considered by the council portfolio committees and the reports on the implementation progress are presented to ward committees.

The expected stakeholders are as follows:

  • Public participation unit
  • Council portfolio committee members
  • Department heads
  • Ward committee members serving in their respective portfolios.

The expected outcome of these meetings is to establish a structural analysis in terms of basic service delivery and the developmental needs of the citizens of Newcastle.  In the absence of the Constituency meetings, the portfolio meetings will provide a grass-root planning platform which will focus on the importance of information gathering that is essential for both strategic and budget priorities.

Municipal departments are expected to do presentations on their respective department programs in connection with service delivery.

No electricity cuts for Newcastle KZN

NO ELECTRICITY CUTS FOR NEWCASTLE KZN

The Newcastle Municipality has saved Newcastle from a major disaster. Eskom announced that they would cut power to the economic hub of Northern KwaZulu Natal as from Monday the 30th of September 2019. The Municipality heard about the news via the Media and decided to apply for a High Court Interdict against the power utility ESKOM to cut power. On Sunday the 29th of September Judge Chetty ruled in favour of the Newcastle Municipality, for arguments on 3rd October 2019.

On the 3rd of October Judge Bezuidenhout heard arguments from Newcastle Municipality and ESKOM. The Municipality was joined by COGTA and one of the largest businesses in Newcastle Lanxess CISA who was entered onto the court documents as a respondent.

Judge Bezuidenhout reserved judgement on the interim interdict until today and instructed ESKOM to adhere to the interdict.
This morning judge Mngadi handed down judgment on behalf of Judge Bezuidenhout at the Pietermaritzburg High Court.

The judgment in short

  • ESKOM is not allowed to cut power to the economic hub of Northern KwaZulu Natal town Newcastle.
  • The Newcastle Municipality must pay ESKOM R30 million per month as from 15th October 2019
  • All parties are granted leave to file supplementary papers by 29th October 2019
  • The matter is set for 6th December 2019This judgement is not only to the benefit of the community and businesses of Newcastle but also to other Municipalities in KwaZulu Natal.

    The mayor of Newcastle , Dr Mhalba would like to inform the community of Newcastle that the Newcastle Municipality will be able to make payment to the power utility. “I will ensure that our CFO make payment on the 15th of every month. We now have a concrete agreement in place, we will not disappoint the people of Newcastle.”

    We are positive that on the 6 of December 2019 the interim order by the court will become final.

PUBLIC NOTICE: PUBLIC PARTICIPATION POLICY & STRATEGY

Notice is hereby given that, in terms of Section 152, subsection (1) (a) of the Constitution of the Republic of South Africa (1996), read in conjunction with Chapter 4, Section 17 of the Local Government: Municipal Systems Act (Act No. 32 of 2000), the Newcastle Local Municipality has developed a Public Participation Policy and Strategy document.

The main objective of this Policy/Strategy is to “make provision for mechanisms, processes andprocedures to facilitate and give effect to public participation as regulated by statute”. The Public Participation Strategy and Ward Committee Operational Plan are a supplement to the Policyand detail procedures and processes to be followed by officials, political bearers and all relevantstakeholders for proper public participation at community level.

The Public Participation Policy and Strategy will be made available for perusal in the following areas:
