NOTICE NO.CS29/2019

RE : NOTICE OF DECLARATION OF DISPUTE IN TERMS OF SECTION 102(2)

This notice is addressed to all customers and/or rate payers of the Newcastle Municipality who have submitted a notice of declaration of dispute in terms of section 102(2) of Local Government: Municipal Systems Act, No.32 of 2000
The Newcastle Municipality hereby acknowledges receipt of the notices dated September 2019 declaring a dispute in terms of section 102(2) of the Municipal Systems Act, in respect of the accounts referred to in the above notices.
We have noted that the dispute is based on an extract from the minutes of the Newcastle Municipal Council meeting held on 29 May 2019.
The Newcastle Municipality denies the allegations raised that "The wording of the decision imposing the tariffs by way of reference is void for vagueness" and that "the empowering legislation was willfully misinterpreted to assist the municipality to increase its income by way of an unjust and irrational increase in property rates".
We further deny the allegation that there has been an "unauthorized increase of the threshold of R15 000.00 in respect of residential properties to R85 000.00".
We submit that the above allegation incorrectly interprets the minutes of the Newcastle Municipal Council as the Municipality had increased the impermissible property value from R 15 000.00 to R85 000.00, which means that property owners are not being charged rates for up to R85 000.00 of their property value.

The Newcastle Municipality has furthermore noted the statement that the affected customers and/or ratepayers shall continue to pay property rates imposed during the previous financial year until the dispute, referred to in paragraph 2 of the notice, is satisfactorily addressed.

We have also taken note of your view that no debt collection and credit control measures may be instituted until such time that the dispute has been resolved and that affected customers and/or ratepayers intend to apply for a spoliation order in the court, costs to be awarded against the Municipality on a de bonis propiis basis.

The Newcastle Municipality's failure, at this stage, to respond to each and every allegation contained in the above notice, should not be construed as an admission thereof and we accordingly reserve the right to respond thereto if necessary and in the appropriate forum.

We submit that the allegations expressed in the notice is based on an incorrect interpretation of Section 102(2) of the Local Government: Municipal Systems Act 32 of 2000 ("the Act").
Section 102 of the Act provides that the Municipality is entitled to consolidate any accounts of the same person relating to a property

If a person, for instance, has a separate account number for rates and for water, the Municipality is entitled to consolidate these two accounts
Should a Municipality however decide to consolidate accounts where there is a dispute in relation to charges on the one account and arrears on the other account, the provisions of Section 102(2) of the Act could apply concerning any specific amount claimed by the Municipality.

According to the Municipality consolidation has already occurred in your instance and you, as the account holder receive a single account.

The affected customers and/or ratepayers are hereby informed that a consolidated account must be paid in full. Should the affected customers and/or ratepayers elect to only pay part of such consolidated account, a Municipality may be entitled to disconnect services.

The affected customers and/or ratepayers are hereby invited, should they have a dispute with the Municipality, to deal with such disputes in a legal manner and to exhaust the remedies afforded to such customers and/or ratepayers as contained in various legislation".

How do we get hold of the Mayor? I have an operational business that needs funding. The business can create many employment opportunities and empower many businesses around our hometown.

It would have been nice to be informed early while the interview was confirmed.

The citizens buy electricity from municipality but municipality is not paying Eskom after their mark up, this is very wrong 🤔🙄😎

The KZN Government is holding a Joint-Exco for the Amajuba District family of municipalities at Newcastle Show Hall. The session is attended by the Premier, MECs, Mayors, Councillors Amakhosi, senior officials and izinduna. This session forms part of the launch of Operation Khawuleza in KZN. After the joint-exco the Premier will  lead the team to the Gama Sports Fields where the public event will be held.Image attachment

Our town and district was one of three municipalities that booked but never participated at the KZN Investment conference on Fiday at the Durban ICC. But no jobs and no future investments for our city! What is the problem.

The KZN provincial government through the Department of Cooperative Governance and Traditional Affairs under the leadership of MEC Sipho Hlomuka, is embarking on an unprecedented and ground-breaking intervention aimed at capacitating municipalities to respond to service delivery challenges that have sparked high level of dissatisfaction in communities.

Heavy plant equipment worth over R125 million is to be given to communities by the provincial government to respond to immediate infrastructure needs that in many instances have sparked service delivery protests
This programme a first of its kind intervention dubbed “Operation Khawuleza” is part of the directive by President Cyril Ramaphosa to attend to immediate infrastructure needs affecting communities.

Operation Khawuleza will be officially launched today in Newcastle at the Gama Sports Ground, Ward 12, Johnstone, Newcastle at 11 AM.

The launch will be attended by the Premier of KwaZulu-Natal, honourable Sihle Zikalala,KZN COGTA MEC Sipho Hlomuka, District Mayor Dr M. Ngubane , Newcastle Mayor Dr. NNG Mahlaba.

Operation Khawuleza is the Provincial Government’s quick response to maintaining roads, fixing and maintaining infrastructure and many other service delivery issues. The Provincial Government led by Premier Zikalala, will handover graders, TLB’s, rollers, water tankers, refuse trucks and fire engines to municipalities across the province.

The equipment that will be rolled out to municipalities comes at no cost and will ensure that municipalities are better able to handle key service delivery issues like the maintenance of roads, which includes the fixing of potholes, and the provision of sanitation and water. “We are committed to working with municipalities as the Constitution compels us to do. We have noted over the past couple of years that this critical sphere of local government is struggling to keep up with the demands of communities. As a response, we have decided to implement this revolutionary programme, which will ensure that municipalities have adequate machinery to be supplied by us so that we can collectively speed up service delivery,” said Hlomuka.
“Through this ambitious programme municipalities within our province are to fix at least 500 potholes a month. This equipment will be closely monitored to ensure that it is utilised effectively and efficiently,” said Hlomuka.

Newcastle municipality, if I pay my bill 1 day late in Newcastle West, I'm cut off. Are you telling me that as we speak, 80% of Newcastle East and 5% of Newcastle West are without municipal services due to non-payment?

As if you are doing us favour, we paid you for that electricity, just keep the lights on on OUR ACCOUNT!!!

Some parts of Newcastle will probably still continue to not have water for another 6 years maybe?, that might have been left out. Reporting such " queries " seems to not be helpful AT ALL.

If we appeal wat will happen. My mum is a pensioner & a widow n depends on her pension mostly. Her light & water is R2300 will she be able to pay half n not have her light account cut

Did you know , you pay an average of R1309-17 every month just for Availabilitys + your rates when you have a account at the Municipality , There after you pay for electricity and water usage at a very high tariff + vat . So calculate that with house and business in Newcastle & part of Newcastle East that falls under the Municipality . That must be a big amount . And still they cant manage . 🤔🤔🤔

Did you know that Mayor: The municipal and the town will experience blackout if Eskom restrict supply to the paying residents due non-payment by the Municipality!

Our rates are too high even if you are not around for a month , we need pre paid . They keep on saying the waiting list is full.

Dear Newcastle Municipality, We are a brewing company and would like to open a brewery in Newcastle in the near future. We understand that most young people are unemployed and are constantly looking for jobs. What role can the municipality be willing to play that will assist Newcastle Brewing Company to grow as a business and create sustainable jobs?

The Mayor must answer the residents questions. Where is all the rates money? Where is all the electricity money? Why was this not projected that there will be a financial crisis?
